POLITICAL E-MAIL: PROTECTED SPEECH OR UNWELCOME SPAM?

Candidates for political office are using unsolicited bulk e-mails to reach the electorate. Commonly known as "political spam," this campaign tactic is an inexpensive supplement to television, radio, and print ads. Advocates claim that campaigning via the internet reduces candidates' dependence on fundraising, but critics detest political spam as the latest nuisance. This iBrief examines the legal basis for political spam, distinguishes political spam from analogous regulated speech, and argues that political spam serves an interest worth protecting.

Spam is spam. It's illegal to do, but politicians seem to think they are above every law they break.

If they can spam the people, then i say on one single date and time, all the people should spam every politician and let them know just what you think about these crooks in office.

The excuse that it's cheaper than running commercials is no excuse to spam people. It would be the same as a person robbing a bank suggesting it's ok to do because he or she won't have to work and 8 hour job and can spend more time with his or her kids.

There's this entire branch of "protected" speech called 'political'. This form of speech is not regulated, doesn't apply to the FTC Do-Not-Call registry, does not apply to decency or moral standards - meaning they can legally lie, mislead, misinform; it's a multi-billion dollar industry filled with circular logic, bubbles of distorted reality and it wants in on your e-mail and once there it's persistent sharing your address with political lists. I can't think of any spam more unwelcome that the political. Once ingrained on your system you will be target for chain e-mails, they will find you snail mail address and your phone number which then begins solicitation's asking for political donations. It's all a business, legally protected and the most unwelcome intrusion of any... but that's politics, it's business with self imposed, self supporting rules that wouldn't fly in the real world.
